Security Deposit: A security deposit of one months rent is required and will be held in a non-interest-bearing account at Chase Bank. This deposit serves as security for the tenant's obligations under this lease. It may be used for unpaid rent, damages beyond normal wear and tear, or breach of lease terms. Upon move-in, both parties will complete a condition checklist. The deposit, minus any deductions, will be returned within 30 days of lease termination with an itemized list of deductions, if any. Maintenance Responsibilities: The tenant must maintain the premises in a clean and sanitary condition, reporting any damages or maintenance issues to the landlord within 48 hours. The landlord will address maintenance requests within a reasonable timeframe, typically within 48 hours for non-emergencies. Entry and Access: The landlord reserves the right to enter the property for inspections, repairs, or emergencies, providing 24-hour notice for non-emergency access. Entries will be conducted at reasonable times and with respect for the tenant's privacy. Rent Payment: Monthly rent of $1800 is due on the first of each month. Payments are accepted via direct deposit, check, or electronic transfer. A late fee of 5% of the monthly rent applies to payments made after the 5th of the month. Renewal and Termination: At the end of the lease term, the tenant may have the option to renew the lease upon mutual agreement. Notice of renewal or termination must be given by either party at least 30 days prior to the end of the lease term. Early termination of the lease by the tenant will incur in a penalty of two months' rent, and breaking the lease without proper notice may result in forfeiture of the security deposit. Property Use and Restrictions: Pets are not allowed, any damages caused by pets will be subject to a fee proportional to the damages along with forfeiture of the deposit. Noise and Conduct: Quiet hours start at 9 PM, as mandated by the condo association. Tenants are expected to adhere to these rules to maintain a peaceful living environment for all residents. Parking: Community parking is available. Tenants must adhere to the condo association's parking rules and regulations. Guest Policy: While there are no specific rules regarding guests, tenants are responsible for the conduct of their guests and ensuring they adhere to the terms of this lease and the condo association's rules. Vacating the Premises: The tenant must provide written notice of intent to vacate at least 14 days prior to the termination of the lease. Insurance: The tenant is strongly recommended to obtain renter's insurance to protect personal belongings from loss or damage and to provide liability coverage. The landlord's insurance does not cover the tenant's personal belongings. Default and Eviction for Non-Payment of Rent: In the event that rent is not paid within two weeks (14 days) of the due date, this will constitute a material breach of the lease agreement. Upon such breach, the following actions shall be taken: 1. Notice of Default: The landlord will provide the tenant with a written notice of default, specifying the amount of rent overdue and demanding payment within a specified period, not less than 7 days from the date of the notice. 2. Right to Cure: The tenant shall have the opportunity to remedy the default by paying the full amount of overdue rent within the period specified in the notice of default. 3. Termination of Lease: If the tenant fails to cure the default by paying the overdue rent within the specified period, the landlord shall have the right to terminate the lease agreement. 4. Eviction Proceedings: Upon termination of the lease, the landlord shall have the right to commence eviction proceedings in accordance with Michigan law. The tenant will be responsible for all costs associated with such proceedings, including but not limited to legal fees, court costs, and any outstanding rent owed. 5. Waiver: Failure by the landlord to enforce this clause on any occasion shall not be construed as a waiver of the landlord's right to enforce it on any other occasion.
