Owner shall be responsible for landscaping and garden maintenance, including the cost of a monthly gardener. b. Tenant shall be responsible for all utility costs, including gas, electricity, Trash collection, Internet and water. 2. SMOKING Smoking is strictly prohibited inside the Property. Violation of this policy will result in a fine and potential eviction. 3. AIR CONDITIONING a. Tenant is responsible for replacing the air conditioning filters every 4-5 months. Failure to do so may result in damage to the system, which shall be the financial responsibility of the Tenant. 4. SPRINKLERS Tenant shall not turn off the sprinkler system. Tenant will be responsible for the cost of water used for irrigation. The home is equipped with weather sensing and water saving smart sprinkler system which uses very little water and will only irrigate if the humidity content in the soil goes low. 5. YARD MAINTENANCE a. Tenant is responsible for the maintenance of all items in the front and backyard, including stones, plants, and any landscaping features. The gardener will visit the Property monthly for basic maintenance tasks such as mowing the grass and cutting leaves but it is the Tenant's responsibility to ensure the yard is clean and well-kept. 6. KITCHEN COUNTERTOP Tenant must maintain the wooden kitchen countertop. Any damage, stains, or marks caused by negligence or misuse will be borne by the Tenant. 7. FIREPLACE The wooden fireplace is non-operational and should not be used under any circumstances. Any damage caused by attempting to use the fireplace will be the financial responsibility of the Tenant. 8. INSPECTIONS Owner or authorized agents may enter the Property for inspections with reasonable notice, typically 2-3 days, except in cases of emergency. 9. GOVERNING LAW This Agreement shall be governed by and construed in accordance with the laws of the state of California, and any disputes shall be resolved within the jurisdiction of the state of California. 10. ENTIRE AGREEMENT This Agreement contains the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral.
